RULES
§1 General provisions
1. These Regulations set out the rules for making purchases at the TRECE STORE online shop, hereinafter referred to as ‘the Shop’, operated by Zuzanna Kuchajewicz, with registered office at 43 Mehoffera Street, 03-131 Warsaw, NIP: 5242986993, and are addressed to consumers, entrepreneurs and businesses with consumer rights.
2. These Terms and Conditions explain and define the terms used in the Store, including but not limited to Days, Customer, Consumer, Consumer Rights Entrepreneur, Customer Account, Terms and Conditions, Store, Service Provider, Goods, Registration Form, Order Form, Order.
3. Prices of goods given in the Shop do not constitute an offer within the meaning of the Civil Code, but an invitation to conclude a contract. Prices are given gross in the currency chosen by the Customer. The cost of delivery and payment is not included in the prices given on the website.
4. Definitions:
1. Business days – means the days of the week from Monday to Friday, excluding public holidays.
2. Customer – a natural person, a legal person or an organisational unit without legal personality, to which the Act grants legal capacity, using the Online Store, including, in particular, making purchases.
3. Consumer – in accordance with Article 22^1 of the Civil Code, a natural person making a legal transaction not directly related to his/her economic or professional activity.
4. Entrepreneur with consumer rights – a natural person running a sole proprietorship who concludes a contract directly related to his/her business activity, when the content of this contract shows that it does not have a professional character for this person, resulting in particular from the subject of his/her business activity, made available on the basis of the provisions of the Central Register and Information on Business Activity.
5. customer account – a set of resources in the Service Provider’s ICT system, marked with an individual name (login) and password, in which Customer data is collected, including information about Orders placed.
6. Rules and Regulations – these Rules and Regulations of the Online Store.
7. Shop – the Online Shop operated by the Service Provider at URL [insert website address of the shop].
8. Service Provider – entity providing electronic services and selling Goods via the Online Shop.
9. Durable medium – material or device that allows the Consumer or Consumer Entrepreneur to store information personally addressed to them in a manner that allows access to such information in the future for a period of time appropriate to the purposes for which the information is used and that allows the reproduction of the stored information in an unchanged form.
10. Goods – products offered for sale in the Online Store.
11. registration form – a form available in the Online Store which enables the creation of a Customer Account.
12. Order Form – an interactive form available in the On-line Store, enabling the placement of an Order, in particular by adding the Goods to the basket and specifying the terms of the Sales Agreement, including the manner of delivery and payment.
13. order – the Customer’s declaration of will, aiming directly at concluding the Contract of sale of the Goods with the Service Provider, placed by means of the Order Form.
§2 Account registration
1. Customers have the opportunity to register with the Store by completing a registration form, which is available on the Store’s website. Registration results in the creation of a Customer Account.
2. Access to the Account registration service is free and possible after completing the registration form, accepting the Terms and Conditions and the cookie policy.
3. After completing the registration form, the Customer will receive an e-mail with a request to confirm the data by clicking on the link contained therein.
4. The Customer may at any time delete his/her Account in the Store by sending a request to the following address: kontakt@trece-store.com.
5. Having an Account allows the Customer to use the functionality of the Store after logging in. The Customer undertakes to keep his/her password confidential and not to make it available to others.
6. The Service Provider may delete the Customer’s Account in the event of a breach of the Terms and Conditions, in particular by providing false personal data during registration.
§3 Placing orders
1. The Customer may make purchases in the Store without creating an Account. To this end, the Customer adds the selected products to the Order Form and confirms his or her decision by clicking the appropriate option on the Store’s website.
2. After selecting the products, the Customer specifies the method of delivery and payment and confirms the total price of the order.
3. Before confirming the order, the Customer must provide his/her true personal data. Failure to provide true data may result in the Service Provider withholding the order.
4. The placement of an order by the Customer constitutes an offer to purchase products from the Store. Confirmation of order placement is tantamount to acceptance of the offer by the Service Provider.
5. Orders containing pre-sale products are fulfilled within a certain time limit, stated on the product page.
6. After placing an order, the Customer receives an e-mail confirming the order and information concerning the concluded contract.
7. The order is fulfilled within the period agreed with the Customer, but no longer than 30 days from the date of placing the order, unless otherwise agreed by the parties.
8. The Service Provider reserves the right to refuse an order in the event that it is not possible to fulfil it, e.g. if stocks run out.
§4 Payments
1. The Seller makes available to the Customer the following methods of payment for the Sales Agreement:
2. electronic payments and payment card payments are carried out through the Przelewy24.pl service – the possible current payment methods are specified on the website of the Online Shop in the information tab concerning payment methods and on the website https://www.przelewy24.pl.
3. Settlement of electronic payment and payment card transactions are carried out according to the choice of the Customer through the Przelewy24.pl service.
4. Electronic payment and payment card transactions are handled by:
Przelewy24.pl – the company PayPro S.A. with its registered office in Poznań (registered office address: ul. Pastelowa 8, 60-198 Poznań),entered in the Register of Entrepreneurs of the National Court Register kept by the District Court Poznań- Nowe Miasto and Wilda in Poznań, VIII Economic Department of the National Court Register under the number KRS 0000347935, share capital: PLN 5,476,300.00 fully paid up, NIP 7792369887, REGON 301345068.
5. The Customer is obliged to make payment within 3 calendar days of the conclusion of the Sales Agreement.
§5 Shipping
1.The cost of delivery of goods ordered in the Shop is calculated in accordance with the applicable delivery price list available on the Shop’s website.
2.The deadline for delivery of the Product to the Customer is up to 5 Business Days, unless a different deadline is specified in the description of the Product in question or when placing the Order.
3. If delivery is delayed, the Customer will be notified of the new delivery date.
4.Delivery of goods takes place in Poland, as well as abroad, in accordance with the information available on the website of the Store.
§6 Complaints and returns
1.The Customer may file a complaint regarding the purchased goods in the event of physical or legal defects of the goods, in accordance with the provisions of the Civil Code.
2.Complaint should be made in writing or through the contact form available on the website of the Store, within 14 days of receipt of the goods.
3.Reimbursement of the amount due for the returned goods, minus the cost of postage less the cheapest delivery option available in the offer, will be made to the bank account specified in the form, within 14 days of receipt of the return
4. The customer has the right to withdraw from the contract within 14 days of receiving the parcel.
5. The customer returns the goods to the Store within 14 days of the declaration of withdrawal from the contract.
6. The goods shall be returned at the Customer’s expense, unless the goods were defective. The goods must be returned intact, in the original packaging.
7. Upon receipt of the returned goods, the Service Provider shall return the corresponding amount to the Customer within 14 days of receipt of the return.
§7 Final provisions
1. These Terms and Conditions shall come into force on the date of publication on the website of the Store.
2. The Service Provider reserves the right to amend the Terms and Conditions. Amendments come into force on the day they are published on the website of the Store.
3. The Customer is obliged to familiarise himself with the current Terms and Conditions before placing an order.
4. In matters not covered by these Terms and Conditions, the provisions of Polish law, in particular the Civil Code and the Law on the Protection of personal data.
5. Any disputes arising from the contract may be considered by the competent court under Polish law.
